Rental Terms and Conditions – T.E.S. Rentals

General Terms

Payment: Net cash 10 days. A 1.5% charge per month (18% per annum) is added to delinquent balances over 30 days.

Lessor may revert all charges to the daily rate if any monthly invoice is unpaid within 30 days. By signing, customer acknowledges proper instruction on safe operation of equipment.

1. Condition of Equipment

Customer acknowledges receipt of equipment in good, safe, and serviceable condition, inspected by lessor and examined at delivery.

2. Use of Equipment

Only authorized persons may use the equipment. Customer agrees not to permit unauthorized use, exposure to fire, hazardous substances, or use under the influence. Proper maintenance and secure transport are required.

3. No Warranty

Lessor is not the manufacturer and provides no warranty against defects in material, workmanship, or capacity.

4. Risk of Use

All equipment is used at customer’s risk. Conditions preventing satisfactory operation do not relieve customer of rental charges.

5. Damage to Equipment

Loss or damage beyond repair will be paid at new replacement value. Repairable damage is repaired at customer’s expense, with charges continuing until repair is complete.

6. Rental / Cleaning

Rental charges begin when equipment leaves the store and continue until return. A $95/hour cleaning fee applies for unclean returns.

7. Return of Equipment

Customer agrees to return equipment on or before the contract end date. Retention beyond five days after “due in” may be reported as stolen under Florida Statute 812.155.

9. Indemnification

Customer shall defend, indemnify, and hold harmless lessor, employees, and agents from claims, liabilities, and damages arising from customer actions, including attorney’s fees.

10. Loss Damage Waiver

An optional waiver limits customer liability beyond deductible if paid in full at rental start. Terms apply as outlined in the Loss Damage Waiver Policy.

11. Reasonable Wear & Tear / Rental Time Limits

Customer is responsible for equipment condition, reasonable wear and tear excepted. Standard rental time is one shift (8 hours/day, 40 hours/week, 160 hours per 4 weeks).

12. Use Overage Charges

Use beyond standard limits reverts to daily rate and is billed at the hourly rate (daily rate ÷ 8).
